Terms and Conditions

This web site (www.ecoffice.com.tw)(the “Site”) is owned by the Law Office of Eric Chung (the “Office”). Please read these Terms and Conditions carefully. By using the Site, you signify your consent to these Terms and Conditions and the accompanying Privacy Policy. If you do not agree with any term in these Terms and Conditions or the Privacy Policy, please do not use the Site.

1. You don’t have to register or create an account with the Site. All information on the Site is made available to the general public without fee or charge.

2. The Office has placed the information on the Site as a service to the general public. Your use of the Site or any information or materials on the Site, including your contact with the Office via online forms, emails, phone calls, or other means through the Site, does not in any manner constitute or create an attorney-client relationship with the Office. An attorney-client relationship is formed only when both you and the Office have signed an engagement letter that details the scope of engagement and the terms thereof. While the information on this site may be about legal issues, it is not intended as legal advice of any kind or as a substitute for the particularized advice of your own counsel. Anyone seeking specific legal advice or assistance should retain an attorney.

3. (a) Materials on the Site is provided for lawful purposes only, and may not be used for any unlawful purposes.

(b) Some areas of the Site may allow you to post or upload information, text, graphics, or other material (“Content” or, when posted by you, “your Content”), and to share your Content with others. You retain ownership of your Content, but there are many things that other users may do with your Content, for example, copy it, modify it, re-share it, or broadcast it. The Office has no responsibility for that activity. Please consider carefully what you choose to share.

(c) You agree not to post Content that (i) may create a risk of loss or damage to any person or property;(ii) may constitute or contribute to a crime, tort, or other illegal activities;(iii) contains any information or content that the Office deems to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, libelous, threatening, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), or otherwise objectionable; (iv) contains any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of anyone’s trade secrets);(v) contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships; or(vi) contains any information or content that you know is not correct and current.

(d) You agree that any Content that you post does not and will not violate rights of any person, including, without limitation, any intellectual property rights or rights of privacy.

(e) You retain full ownership to your Content, but you agree to grant the Office a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, publish, process, adapt, modify, edit, translate, make derivatives, display, transmit, and distribute such Content in connection with services provided by the Site.

(f) The Office reserves the right at all times, but is not obligated, to remove, reject, or refuse to distribute any Content on the Site including your Content. The Office also reserves the right to access, read, preserve, and disclose any information as it reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process, or governmental investigation or request; (ii) enforce these Terms and Conditions, including investigation of potential violations; (iii) detect, prevent, or otherwise address fraud, security, or technical issues; (iv) respond to user support requests; or (v) protect the rights, property, or safety of the Office, its users, and any others.

4. All right, title, and interest in and to the Site (excluding Content provided by users) are and will remain the exclusive property of the Office and its licensors. Material on the Site is protected by copyright and other law and may not be copied, reproduced, distributed, republished, uploaded, posted, or transmitted in any way without the Office’s prior written consent. All trademarks on the Site are property of the Office or of third parties. Nothing in these Terms and Conditions gives you a right to use the Office’s name or any of the Office’s trademarks, logos, domain names, and other distinctive brand features.

5. The Office respects the intellectual property rights of others, and requires that users who use the Site do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact the Office and forward the following information to the Office:

  • A description of the copyrighted work that you claim has been infringed;
  • A description of the alleged infringing activity and where the alleged infringing material is located;
  • A statement by you that you have a good faith belief that the disputed use is not authorized by you, the copyright owner, its agent, or the law;
  • A statement by you that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

6. (a) All Content on the Site, whether publicly posted or privately transmitted by users, is the sole responsibility of the person who originated such Content. The Office does not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Site or endorse any opinions expressed via the Site. The Office may not monitor or control the Content posted via the Site, and the Office cannot take responsibility for such Content. If you use or rely on any Content or materials posted via the Site or obtained by you through the Site, it is at your own risk.

(b) Under no circumstances shall the Office be liable in any way for any Content, or any loss or damage of any kind incurred as a result of the use of any Content on the Site.

(c) You agree that you are responsible for your use of the Site, for any Content you provide, and for any consequences thereof, including the use of your Content by other users and third parties. You understand that if you do not have the right to submit Content to the Site, doing so may subject you to liability. The Office will not be responsible or liable for any use of your Content by the Office in accordance with these Terms and Conditions. You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any Content that you submit including all necessary rights to upload your Content for use in accordance with these Terms and Conditions.

7. The Site is provided on an “as is” and “as available” basis. Use of the Site is at your own risk. To the maximum extent permitted by applicable law, the Site is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Office is not liable for any losses or damages that relate to, arise out of, or result from the use of, or access to, or the inability to use, any of the materials on the Site. Without limiting the foregoing, the Office and its licensors do not warrant (i) that the content is accurate, reliable or correct; (ii) that the Site will meet your requirements; (iii) that the Site will be available at any particular time or location, uninterrupted or secure; (iv) that any defects or errors will be corrected; or (v) that the Site is free of viruses or other harmful components. Any content downloaded or otherwise obtained through the use of the Site is downloaded or obtained at your own risk and you will be solely responsible for any damage to your computer system or other devices or loss of data that results from such download or your use of the Site. The Office do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Site or any hyperlinked web site or service, and the Office will not be a party to or in any way monitor any transaction between you and third party providers of products or services.

8. The Office reserves the right to amend the Terms and Conditions and Privacy Policy at any time in its sole discretion. Amendments to the Terms and Conditions and Privacy Policy become effective upon posting. It is your responsibility to review the current Terms and Conditions and Privacy Policy in force when using the Site.

9. The Office is located in Taipei, Taiwan. All matters relating to the Site should be governed by the laws of Taiwan and subject to the jurisdiction of the Taiwan Taipei District Court.
